Estate Planning & Probate

Foulston Siefkin attorneys have substantial experience in providing the full breadth of estate planning and trust and probate administration services at our three Kansas offices located in Wichita, Topeka and Overland Park, Kansas. The firm meets client needs by providing individually tailored documents, including wills and revocable trusts, irrevocable trusts created during lifetime and trusts created following death under the provisions of wills and revocable trusts, health and financial powers of attorney, living wills and other advance directives, and premarital and buy/sell agreements. In addition, Foulston Siefkin provides a wealth of ancillary legal services attendant to estate planning and probate matters, including an analysis of the proper and improper use of the various probate avoidance techniques; the proper titling of property and funding of revocable trusts; crafting tax-saving gift, estate and income tax strategies; structuring farms and closely held businesses to facilitate the orderly transfer of control and wealth to successive generations; representing clients as fiduciaries in probate and trust administration; representing beneficiaries of trusts and estates in litigation matters; and utilizing disclaimers and other effective post-death estate and income tax saving techniques.

In addition to being very proficient at the foregoing traditional estate planning documents and matters, our estate planning and probate group lawyers have been at the forefront both in Kansas and nationally on such progressive and beneficial estate planning techniques as advising clients on family harmony preservation strategies during the designing and implementation of the estate plan, asset protection planning, planning to avoid accelerating distributions from qualified retirement plans and IRAs, ensuring the integrity of the marital estate plan in the event of a remarriage of a surviving spouse, estate planning for “blended family” marriages, wealth preservation through the use of multi-generational trusts, governmental resource planning to maximize Medicaid and SSI benefits, and employing reciprocal general powers of appointment between spouses in the provisions of wills and revocable trusts to maximize estate tax savings and asset protection benefits. As a result of our group having a significant number of highly knowledgeable and experienced attorneys who practice in the estate planning and probate area, a large support staff of paralegals, a tax and probate and trust administration analyst, and one of the most comprehensive and sophisticated proprietary estate planning form systems in the United States, we are able to provide very efficient and highly sophisticated estate planning services to clients irrespective of the amount of their wealth.

The attorneys in our estate planning and probate group are named on regional and national “best of” tax and estate planning attorney lists, frequently speak on estate planning and probate matters before regional and national attorney associations and other professional groups, regularly author on estate planning and probate topics for regional and national law journals and other well-known publications and treatises, have prominently served and held leadership positions in state and national attorney associations and committees focusing on estate planning and probate issues, have taught estate planning courses at various law schools, have represented clients in high profile district court and appellate court cases involving estate planning, tax and probate issues, and have been actively involved in drafting and lobbying for many of the Kansas estate planning statutory provisions addressing estate tax, probate, trust and related matters.
